Terms of Service

By placing and confirming a commission with me, you agree to all the below terms stated.
1. Payment.
Once confirming a commission and agreeing to the final price and sketch provided, 50% of the total price must be paid up front. At no point after this may the 50% be refunded, with the exception if the order must be cancelled on my end. Once the commission is finished and you are pleased, you must pay the remaining 50% before receiving the final .psd file.
Payments may be made through PayPal only. Only exceptions are with in-person orders, which may be paid through cash or card. Below is the PayPal you would send payment to:
paypal.me/okamenart
2. Edits / Changes
Each commission is allowed up to 3 edits or changes after the final product is sent. You may not request any edits or changes after you confirm you are happy with the commission.
During the process, I will send you update emails of the product in-progress. If you notice any errors or would like to point out changes during this time, they will not count toward your allotted 3 edits. You will have as many as you need while I sketch and show progress.
3. Usage
For personal use, I will send you a .psd file of your final product that will have each individual layer, including the topmost layer that is my signature. For personal, non-public usages (including but not limited to: personal DMs with friends or printing and displaying in your home), you may remove the signature if you would like. Any public usages (including but not limited to: posting to social media, using as a banner, or posting to public Discords) must have my signature included, and under no circumstances may be altered or hidden.
If you receive art from me in-person, you will by default have a signature on the artwork, and will not be sent a .psd file of the artwork. However, real life usage is incredibly lax so long as you do not remove or alter my signature.
Exceptions to this are pixel art or illustrations made specifically as a profile picture, and Live2D Cubism models. These will never include a signature visually. Instead, for the above cases, you must credit me elsewhere, such as in a footer or a bio.
You may directly credit my Twitter or Instagram.

4. Ordering
If you decide you’d wish to place an order, email me at okamen.art1@gmail.com and be sure to include somewhere this form filled:
What you’d like
+ Specific Item Descriptor (Price)
+ Specific Item Descriptor (Price)
+ Specific Item Descriptor (Price)

Total Price
For Example:
Digital Illustration
+ Flat Color ($20)
+ Fullbody (2) ($40)
+ Detailed BG ($40)
__________________________
$100
Please be as descriptive as you can. Tell me every detail in their personality that matters, show me plenty of pictures, show me whatever inspiration you think might point me in the right direction to your idea. It only helps us both, trust me! There’s no such thing as too many examples!
Depending on how I rate the complexity of characters, scenarios, etc. I may adjust the final price to make it more fair to the extra work it will take to get it done right. However, once I finalize the price and you agree, no further changes to the price will be made.
Expect at least a few follow up / question emails throughout the period of the order. If you are on a waitlist, I will update you when you’re getting started, I will ask for more details, and I will check in to make sure you’re liking the way it’s going!
5. Waitlisting
In the event there are too many orders to work on at once, I’ll let you know what space in line you will be, and ask if you would like to be added there. If you agree, no payment is required until it is specifically your turn. You may exit the waitlist at any time, just shoot me an email.
If you would like to order another commission after your initial order has started, it will unfortunately be put at the back of the waitlist line.
I will not update you every time your spot in the waitlist moves up; only where you start and when it’s your turn. You may email me at any time to ask for your current position, though.
6. Cancellations
If, for whatever reason, you must cancel your order, you will not receive a refund for the initial 50% down payment.
After requesting to cancel, I will send you the current stage of the work. Be it a sketch, be it some lines, you will be able to keep it and use it in like a finished order. And, if at any time you may wish for me to continue, you can send that work in progress file back and I can pick up where I left off.
If you wish to continue an order after cancellation, you will have to pay +50% of the original grand total. Same rules of 50% down payment first and 50% once finished apply.
7. Plagiarism
Do not use any of my artwork online and claim it as your own. Please provide credit somewhere in, for example, posts on social media.
Tracing over my artwork and claiming it as your own is prohibited.
8. Rights
By purchasing and receiving a finished commission from me, You have the right to use it and post it anywhere you would like. You have the right to make any edits to it as you want. You may not claim yourself as the artist. You may not alter it against any of the prior rules listed. You may sell your rights to it, so long as you let me know who the new owner is and they agree to these rules as well.
You may print it in any medium you would like. If you need slight help with resizing please send me an email!
9. Questions
If you have any questions at all, about the progress, my process, etc., please don’t hesitate to send me an email! I want everything to be as crystal clear between this project as possible, and there is never any need for confusion. If you have questions about the TOS, please let me know as well.
